En primer lugar, debemos aclarar que esta normativa no es de carácter municipal como muchas anteriores que han entrado en vigor en los municipios con gran afluencia de turismo como por ejemplo, San Sebastián / Donosti, Bilbao o Vitoria. Esta normativa se aplica a todo el territorio de Euskadi.
En vista del nuevo Decreto entrado en vigor el pasado mes de julio 2018 sobre el alojamiento turístico en Euskadi, a continuación, mostramos las claves de esta nueva regulación. Esta nueva normativa pretende legislar los inmuebles que se comercializan y promocionan en plataformas web como Booking.com, Airbnb, Homeaway u otras páginas de alquiler vacacional similares.
En primer lugar, aquellos propietarios o representantes de viviendas destinadas al alquiler vacacional, tendrán 6 meses desde la entrada en vigor del Decreto 101/2018 para cumplir con los nuevos requisitos administrativos y edificatorios.
Tal y como queda estipulado en el Artículo 5 del Capítulo II del Decreto, todo aquel propietario o representante de la vivienda destinada a la actividad de alquiler vacacional en la comunidad autónoma del País Vasco Deberá firmar una Declaración Responsable (adjuntada en el Anexo I del documento oficial del Decreto 101/2018) y cumplir los requisitos exigidos en la normativa en materia de seguridad e infraestructura. Dicha documentación será objeto de estudio y comprobación del Gobierno Vasco. Con el fin de que la resolución del Gobierno Vasco sea favorable, las viviendas cedidas para la actividad de alquiler turístico deben disponer de al menos una cocina, un cuarto de baño y un dormitorio, y una superficie mínima según el número de residentes que se vayan a alojar. Además, en las actividades de promoción o comercialización de la vivienda como alquiler turístico en Euskadi en plataformas web como Booking.com, Airbnb o Homeaway, deberá incluir el número de registro del Gobierno Vasco. Asimismo, el nuevo Decreto limita a 8 el máximo de plazas ofertadas por vivienda de alojamiento turístico. Al hilo, el Decreto mantiene en el Artículo 13 las medidas estipuladas en torno a la superficie requerida dependiendo de las plazas máximas ofertadas:
-Una vivienda para 1 persona deberá disponer como mínimo de 25 metros cuadrados útiles de superficie.
-Una vivienda para 2 persona deberás disponer como mínimo de 33 metros cuadrados útiles de superficie.
-Una vivienda para 3 o más personas deberá disponer como mínimo de 15 metros cuadrados útiles de superficie por persona.
Resulta necesario prestar especial atención al Artículo 12, puesto que éste obliga a los propietarios o representantes de las viviendas cedidas para la actividad alojativa turística a cumplir con los siguientes requisitos edificatorios:
-Las viviendas que se cedan en su totalidad habrán de disponer al menos de cocina, cuarto de baño y una estancia destinada a dormir, considerándose como tal, además de los dormitorios, las salas de estar habilitadas a ese fin.
-En el caso del alquiler vacacional por habitaciones, además de cocina y cuarto de baño, contarán con, al menos, un dormitorio destinado al alojamiento turístico, distinto de los reservados a las personas que tengan en ella su residencia efectiva.
-Los dormitorios y salas de estar que se destinen a dormir, deben tener iluminación natural y ventilación directa a exterior.
-Las viviendas, dispondrán de un cuarto de baño por cada 4 personas, con lavabo, inodoro y plato de ducha o bañera.
A diferencia del Decreto anterior, el Gobierno Vasco ha diseñado una “herramienta visual” mediante la cual pretende que el alquiler vacacional se haga de manera transparente y segura: las viviendas o habitaciones en viviendas de particulares destinadas a la actividad de alojamiento turístico deberán mostrar en el portal del edificio donde está localizada tal vivienda y en la propia puerta del alojamiento, un distintivo que identifique el inmueble como alojamiento turístico. Asimismo, con el fin de regular y proteger los inmuebles turísticos y los usuarios que hagan uso de éste, el Artículo 15 determina que el alojamiento turístico deberá incluir las medidas de seguridad, así como la identificación de las salidas de emergencia, un extintor manual o los números telefónicos necesarios en caso de emergencia. Además, el Artículo 17 obliga a los responsables de la propiedad a contratar y mantener vigente un Seguro de Responsabilidad Civil durante la totalidad de la actividad alojativa turística: éste debe cubrir al menos 35.000€ por plaza.
Con la entrada en vigor del Decreto 101/2018, el Gobierno Vasco promete tanto agilizar los procesos administrativos como garantizar la seguridad jurídica mediante la dotación a usuarios y consumidores de diversas herramientas.
